Emerald Merch Hub – Terms & Conditions

Thank you for choosing Emerald Merch Hub for your custom apparel, workwear, headwear and promotional products.

These Terms & Conditions apply to all quotes, orders and purchases unless otherwise agreed in writing.

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL).

1. Quotes & Pricing

1.1 Quotes are valid for 7 days from the date issued unless otherwise stated.

1.2 Quotes are based on information supplied at the time, including quantity, product type, artwork, branding method and delivery location.

1.3 If order details change after quoting, we may revise pricing.

1.4 Prices are in AUD and include GST where stated.

2. Orders & Acceptance

2.1 Orders are confirmed once:

• the quote is accepted;
• any required deposit/payment is received; and
• artwork, sizes and order details are supplied.

2.2 We may decline an order if stock is unavailable, artwork cannot be produced, or the order breaches law or third-party rights.

3. Production & Turnaround Times

3.1 Production times provided are estimates only unless expressly guaranteed in writing.

3.2 Turnaround begins after final artwork approval, payment and all order information are received.

3.3 Delays may occur due to stock shortages, freight delays, supplier issues, public holidays or events beyond our control.

3.4 If delays arise, we will provide an updated timeframe where possible.

4. Indent / Custom Orders

4.1 Some custom-made or indent products require extended lead times.

4.2 Where a physical sample is required, production begins after sample approval.

4.3 Sample production may take approximately 3 weeks unless otherwise advised.

5. Artwork Requirements

5.1 Clients should provide artwork in high-quality digital format where possible (.AI, .EPS, .PDF, .PNG, high-res JPG).

5.2 If artwork requires recreation, clean-up, digitising or design work, extra charges may apply.

5.3 The client warrants they own or have permission to use all supplied logos, names and artwork.

6. Proofing & Approval

6.1 Mock-ups, proofs or samples must be checked carefully for spelling, colour, sizing and placement.

6.2 Once approval is given, production may begin.

6.3 Changes requested after approval may incur extra charges and delay production.

7. Payment Terms

7.1 Unless otherwise agreed:

• Orders under $1,000 may require full payment upfront.
• Orders $1,000+ may require a 50% deposit, with balance due before dispatch.

7.2 We accept approved payment methods including bank transfer and PayPal.

7.3 Goods remain property of Emerald Merch Hub until paid in full.

8. Shipping & Delivery

8.1 Shipping costs are additional unless stated otherwise.

8.2 Delivery dates are estimates only and depend on third-party carriers.

8.3 Risk passes to the customer on delivery or collection.

8.4 Customers should inspect goods promptly and notify us within a reasonable time of any issue.

8.5 International buyers are responsible for customs duties, taxes or import charges.

9. Product Variations

9.1 Due to garment manufacturing and branding processes, reasonable minor variations may occur in:

• thread shade
• print colour tone
• logo placement
• garment sizing tolerances
• stitching finish

9.2 Minor variations that do not affect usability or overall appearance are not faults.

10. Returns, Refunds & Consumer Guarantees

10.1 Custom or personalised products are generally not refundable for change of mind once production has started.

10.2 If goods are faulty, not as described, or fail guarantees under the ACL, we will provide an appropriate remedy, including repair, replacement or refund where required by law.

10.3 Claims should include photos and order details.

11. Cancellations

11.1 Orders may be cancelled before production begins.

11.2 If work has started (including design, digitising, ordering stock or production), we may charge reasonable costs already incurred.

11.3 Special indent/custom supplier orders may not be cancellable once placed.

12. Intellectual Property

12.1 Clients retain ownership of their supplied artwork.

12.2 You grant Emerald Merch Hub permission to use supplied artwork solely to complete your order.

12.3 Unless requested otherwise in writing before production, we may photograph completed products for marketing or portfolio use.

13. Liability

13.1 To the extent permitted by law, Emerald Merch Hub is not liable for indirect or consequential loss, including loss of profits or business opportunity.

13.2 Nothing in these Terms limits rights that cannot legally be excluded under the ACL.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

15. Acceptance

By accepting a quote, paying a deposit or placing an order, you agree to these Terms & Conditions.
